WEDDING PHOTOGRAPHY AGREEMENT

1. PARTIES

This Agreement is entered into between [YOUR BUSINESS NAME] ("Photographer") and [CLIENT NAME(S)] ("Client") on [DATE].

Hawaii GET: Hawaii General Excise Tax of 4.712% will be added to all invoices.

Late Payment: Payments received after the due date are subject to a late fee of $[AMOUNT] per week.

5. CANCELLATION POLICY

Client Cancellation:

  • 180+ days before event: Retainer forfeited, no additional fees
  • 90-179 days before event: 50% of total fee due
  • Less than 90 days before event: 100% of total fee due

Date Changes: Subject to Photographer's availability. If Photographer is unavailable for new date, this shall be treated as a cancellation.

Photographer Cancellation: If Photographer must cancel due to illness, emergency, or unforeseen circumstances, Photographer will make reasonable efforts to secure a qualified replacement photographer or provide a full refund of all payments received.

6. FORCE MAJEURE

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to: natural disasters, hurricanes, government actions, venue closures, or public health emergencies. In such events, parties will work together in good faith to reschedule or refund as appropriate.

7. COPYRIGHT & IMAGE USAGE

Copyright: Photographer retains full copyright to all images created under this Agreement.

Client License: Client receives a non-exclusive, unlimited license to use images for personal, non-commercial purposes, including printing, sharing on social media, and personal display.

Commercial Use: Any commercial use of images requires separate written permission from Photographer.

Credit: When posting images online, Client agrees to credit Photographer when reasonably possible.

8. MODEL RELEASE & PORTFOLIO USE

Client grants Photographer permission to use images from this event for portfolio, website, social media, advertising, print publications, and submission to blogs/magazines. Client understands no compensation is due for promotional use.

Opt-Out: Client may opt out of portfolio use by providing written notice prior to the event date. Opt-out request: [ ] YES, I opt out of portfolio use

9. COOPERATION & ACCESS

Client agrees to:

  • Provide Photographer reasonable access to all events for coverage
  • Allocate minimum [30] minutes for couple portraits
  • Communicate any venue restrictions, timeline changes, or special requests in advance
  • Ensure family and wedding party cooperation for formal portraits

Guest Photography: Guest photography is welcome but must not interfere with professional coverage. Photographer is not responsible for blocked shots due to guest interference.

10. EDITING & CREATIVE CONTROL

Editing style, color treatment, and final image selection are at Photographer's professional discretion, consistent with Photographer's portfolio style. RAW/unedited files are not provided. Requests for re-editing may be accommodated for an additional fee.

11. LIMITATION OF LIABILITY

In the unlikely event of failure to perform services as specified in this Agreement, Photographer's liability is limited to a refund of fees paid. Photographer shall not be liable for any consequential, incidental, or special damages.

Photographer is not responsible for photographs not captured due to circumstances beyond control, including but not limited to: guest interference, weather conditions, venue restrictions, equipment failure, or timeline changes.

12. DATA RETENTION

Online gallery will remain active for [12] months from delivery date. RAW files are retained for [12] months following delivery. Client is responsible for downloading and backing up images during this period. Extended storage is available upon request for an additional fee.

13. HAWAII-SPECIFIC PROVISIONS

Weather: Hawaii weather is unpredictable. Brief rain showers do not constitute grounds for cancellation or refund. Client is responsible for identifying backup locations for outdoor ceremonies.

Permits: Client/Wedding Planner is responsible for obtaining necessary venue and beach permits. Photographer maintains required commercial photography permits for state beaches.

Travel: For inter-island travel or remote locations, additional travel fees may apply as specified in the attached pricing sheet.

14. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements. Any modifications must be in writing and signed by both parties.

15. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Hawaii.

Videography Contract Additions

Additional Clauses for Wedding Videography

Add these clauses to your base contract when providing videography services.

VIDEO SERVICES & DELIVERABLES

Videographer agrees to provide the following:

AUDIO RECORDING

Client agrees to allow Videographer to place wireless microphones on the officiant and/or groom for vow capture. Client is responsible for communicating with officiant and DJ/band regarding audio access.

Audio quality depends on cooperation of officiants, musicians, and venue conditions. Videographer is not responsible for audio issues caused by wind, background noise, or equipment placement restrictions imposed by venue or officiant.

MUSIC LICENSING

Videographer will use properly licensed royalty-free music for all video deliverables. If Client requests specific copyrighted songs, Client is responsible for obtaining appropriate licenses or understanding that videos with unlicensed music may be removed from online platforms.

RAW FOOTAGE

RAW video footage is not provided as a standard deliverable. RAW footage may be available for an additional fee of $[AMOUNT], delivered on client-provided hard drives.

VIDEO EDITING & CREATIVE CONTROL

Song selection, editing style, pacing, and final cut are at Videographer's professional discretion. Client will receive [ONE/TWO] rounds of revision requests for the highlight film. Additional revisions may incur fees.
